The law, signed by Abraham Lincoln, that granted 160 acres of surveyed public land to a settler who resided on and improved it, accelerating the settlement of the American West. About forty percent of those who filed a claim carried it through to a title; how much of the land granted under it went to genuine settlers rather than fraud and speculation is still argued.

About 40 percent of filers completed the process to final title; historians disagree on how much of the granted land reflects manipulation by land companies and speculators using dummy entrymen against ordinary settlers who simply failed. Earlier scholarship stressed widespread fraud, more recent work argues it was comparatively minor.

Open Questions (1 open question)
How much of the Homestead Act's granted land went to fraudulent or speculative claims rather than genuine settlers?

About forty percent of filers completed the process to a final title, but historians disagree sharply on how much of that total reflects manipulation by land companies, cattle ranchers and speculators using dummy entrymen, against ordinary settlers who simply failed or gave up. Earlier scholarship stressed widespread fraud; more recent work argues fraud was a comparatively minor element.

What would resolve this A systematic accounting of surviving General Land Office case files distinguishing contested, canceled and fraud-flagged claims from ordinary relinquishments across the full span the act was in force, rather than the regional case studies the debate currently rests on.
